Studio Policies updated March 2019 

Custom Sessions

Every Custom Session runs a little different from the others so your custom portrait contract will reflect your session information, the pricing, time and date and more. If you have questions about the studios policies please review your custom session contract before signing it and reach out to the studio.  

But just to review some of the details available in advance:

TERMS AND CONDITIONS

SESSION INFORMATION

1. Client is responsible for their own safety and actions while at the location of the portrait session. Kimberly Scott PhotoART and Associates are not responsible for any liability, accidents, illnesses, damage or loss to person or property that may result from the photography session or anything related to the photography session. This includes but is not limited to arriving and departing the studio or outdoor locations. Client maintains the right to refuse any request put forth by Kimberly Scott PhotoART or Associates during the session to obtain a photo, however agreement to those requests removes liability from Kimberly Scott PhotoART and its associates.

2. If anyone should fall ill or the client needs to cancel or reschedule the session due to an emergency, the client should contact the studio as soon within 24 hours of the session.  A new date must be discussed and decided upon with Kimberly Scott within 1 week. If, in the opinion of Kimberly Scott PhotoART, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of Kimberly Scott PhotoART, we may elect to use an alternate location or reschedule the session. 

If Kimberly Scott PhotoART should fall ill everything will be done to provide an associate photographer of equal skill to take over your session. If one cannot be found your session will be refunded in full and shall have no further liability with respect to the contract. If client refuses to allow the associate photographer to photograph the session no refund will be made. 

3. If Kimberly Scott PhotoART cannot perform this contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to an emergency, and Kimberly Scott PhotoART is unable to reschedule the session, then all payments will be refunded to the client and Kimberly Scott PhotoART shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged. In the event Kimberly Scott PhotoART fails to perform for any other reason, Kimberly Scott PhotoART shall not be liable for any amount in excess of the retail value of the client’s order or session fee.

In the event of weather a rain date may be provided for your session.  To insure protection of our camera equipment Kimberly Scott PhotoART and associates will NOT shoot in the rain. This damages our equipment and cause costly repairs and replacements.  Your session is not refundable because of a weather delay or rain date reschedule. 

PHOTO DELIVERY & PRODUCTS

4. Within approximately two to three weeks (*up to 8 weeks during peak seasons) of your session, an email will be sent with a link to view client portraits. Images are selected and edited at Kimberly Scott PhotoART's discretion.  Kimberly Scott reserves the right to edit and release only those images deemed creditable as professional in quality and within Kimberly Scott PhotoART's artistic standards. The photos will be available for viewing, downloading, and purchasing, in a password protected gallery, for 30 days.  No Raw images are available to be released. 

5. Product ordering and downloading must take place within 30 days of the gallery being live before the gallery may become inactive. A $50 re-hosting fee will apply to galleries that need to be put back on the website after the gallery has been removed after 30 days. If the pricing has changed since your original booking date, your images will be re-hosted at Kimberly Scott PhotoART's new pricing. If you cannot make your ordering appointment or cannot order before the 30 day deadline you MUST contact Kimberly Scott PhotoART and a new contract will be made to insure that the pricing reflects the current price list.

6. Simple fixes, such as crops and blemish removal may be completed at the Photographer’s discretion. If more extensive retouching is requested by client, further editing is done at a fee of $25 per image. 

7. Please examine all images in your gallery thoroughly. Due to the custom and digital nature of photography, refunds are not available. Once you download and receive your images you cannot make changes, pick different images, or return them. All sales are final. During your ordering appointment you will be given time to review your order not once but 3 times to insure the order is accurate and reflects what you are wanting to purchase. The studio is a no haggle, no hassle business and you will never be pressured into ordering something you do not want. 

8. Proofing gallery images and purchased images are kept on file by Kimberly Scott PhotoART for one year after portrait session. Every effort is made to secure equipment back-up, however due to the unreliability of digital equipment, data loss can occur at any time; except as explained herein, Kimberly Scott PhotoART shall not be liable for any loss of digital data. It is highly recommended to that you back up your back ups to secure location(s). 

9. No part of any order will be delivered until the balance is paid in full. Once an order has been placed whether prints, products, or digital files your order is final and cannot be changed. Client is responsible for total payment of order. If for any reason the client fails to make complete payment, Kimberly Scott PhotoART has the right to seek legal action to retain the full payment due. If Kimberly Scott PhotoART chooses to retain council in order to attain final payment, any and all legal fees will be charged to the client in addition to the total due. Payment Plans are available and we are happy to assist you with any of your portrait needs and payment needs over time. If you are having any trouble making your payments you need to contact us before your final payment date to make new arrangements.

10. Print issues (i.e. damage during shipping, discoloration of photo, missing items) Clients must come to the studio in person to pick up order. During pick up, client will review their order and the items they are receiving. During this time if any items are missing, damaged, or discolored/incorrect a new form will be filled out detailing the issues and a new order will be placed at no additional charge to the client. A new delivery date will be issued at this time.
After the client has received and signed for delivery of their order, the studio is no longer responsible for those items.

If client insist or is not available for studio pick-up after 14 days of the product arriving to the studio we will make one last attempt to schedule a order pick-up. If at that time client is no longer in the area and request for prints or products to be shipped the client is responsible for the FULL Shipping price (shipped insured/tracked) of the items.  In addition to the shipping price there will be no additional guarantees on the prints and products. We will review each item before placing it in the shipping box but once out of the studio there will be no reprints made for damage during shipping, discoloration of photo, missing items) .

11. Client is aware that color dyes in photography may fade or discolor over time due to the inherent properties of dyes, and client releases Kimberly Scott PhotoART from all liability for any claims based upon fading or discoloration of any photographs. Please review the care instructions that come with your product and make sure you follow them.

NOTICE OF COPYRIGHT AND MODEL RELEASE

It is illegal to copy or reproduce these photographs or videos elsewhere without Photographer’s permission. Violators will be subject to civil and criminal penalties pursuant to Federal Law, beginning at $500.00 per image.

The included images may not be entered into contests, sold, copied, scanned, or used commercially in any format, digital, printed or otherwise unless agreed upon in writing by Kimberly Scott PhotoART and Client.
The images may not be used in any form other than private usage without express written permission from the copyright owner, Kimberly Scott. Kimberly Scott retains all publication and general reproduction rights for these images.

Model Release

I (“Client”) hereby grant to Kimberly Scott/Kimberly Scott PhotoART and her employees, legal representatives, transferees and assigns (“Photographer”), the irrevocable and unrestricted right to use and publish photographs of me and the people listed above, or photographs in which I or the people listed above may be included, for editorial, trade, advertising, commercial, publicity, illustration and any other lawful purpose and in any manner and medium; to alter the same without any restriction; and to copyright the same for Kimberly Scott's sole and exclusive use and benefit. I hereby release Photographer and her employees, legal representatives, transferees and assigns from any and all claims and/or liability relating to said photographs. I further release Photographer and her employees, legal representatives, transferees and assigns from any and all claims and/or liability relating to all photography sessions.

This contract incorporates the entire understanding of the parties. Any modifications of this contract must be in writing and signed by both parties.

Special events 

Special Events are for Santa, Reindeer, Live Bunny/ Lamb, and a few others. 

 

Special Event sessions run entirely on their own and a custom contract is not required before booking but the same policies as custom sessions still apply.

Your Special Event TICKET purchase acts as the session agreement and contract.  Please review all the information provided in the event description before your purchase. All sales are final and binding.

Special Event Sessions

All payments are due in full at booking. This is a nonrefundable event. 

No refunds will be made under any circumstances if you are late or do not show up. 

No switching times or dates.  

Sessions are transferable to another person with a 7 day notice. (Session must be transferred for the exact same total that you purchased for. Ticket Scalping is not allowed if caught the time slot will be rendered invalid!)

 

Special Event Pricing for 2019 (Subject to change for the 2020 year).

Additional Prints and Products are available for purchase upon request.

1- Single High Resolution Digital Image $90

Special Events are a no exception photography event.

We cannot guarantee your child will respond and react to Santa or Live Animals like you want. 

We do recommend that you spend time with your child leading up to your session(s) talking to them about Santa, showing them images and videos and even if you can dress up as Santa at home to help your child not be afraid the day of their session.

The studio cannot guarantee poses but will do our to get the best images for you.  This includes poses with any of the animals that may visit the studio.

Why are special event sessions non-refundable?

We take a great deal of time to plan and schedule your session(s). The studio has to reserve the event locations, assistants, and animals handlers in advance which are non-refundable to us as well.  

 

PHOTO DELIVERY & PRODUCTS

Limited and Special Event sessions usually have under a 7 day turn around for images. There will be ZERO editing done on any of the portraits in advance. ONLY AFTER your agreed upon digital or product order is placed will we go in and do minor retouching (unless otherwise stated.  Images are selected and edited at Kimberly Scott PhotoART's discretion.  Kimberly Scott reserves the right to edit and release only those images deemed creditable as professional in quality and within Kimberly Scott PhotoART's artistic standards. ALL SALES ARE FINAL - NO REFUNDS ARE AVAILABLE

- To transfer your session you must inform us of your intent to transfer. You will be required to sign a session transfer contract which transfer the session to the new client (who must be listed.)

Client who is receiving the session must have paid in advance to us and will be noted in the transfer contract. 

YOU MUST BRING your ticket to the event AND must bring a VALID ID that shows the matching name of the ticket purchaser. If you fail to do this you will not participate in the event. 

DEADLINE FOR ORDERING 2019 

Valentines: January 20th (Little Black Books are custom fro Europe and take longer to ship)

Easter: March 20th

Thanksgiving: November 15th

Christmas: December 15th 

If for any reason there is a refund back to a client there will be a 3.5% processing fee deducted from the total due back to client.

*Because of new CC and PAYPAL regulations the 3.5% is due to them regardless of a refund or not. So any time you as a client request a refund because of whatever the reason our company is out that fee. 

 

*Kimberly Scott PhotoART will ONLY deduct the total processing fee from the refund. If requested a screenshot will be provided to show each client what that total is. 
 

Kimberly SCott PhotoART hates this new regulation just as much as you do but our studio should not go into the negative for your session because you for whatever reason need a refund. All details about the session, refund policies, rain out dates, reschedules and more are available PRIOR to booking.
